When me moved into our council house i think we was told we cannot cut the tree down as there is a tpo on the tree ::b so the house has been sold to a housing organisation so i phoned them up to ask if they can trim the tree as it's higher than the house and the branches won't be long before they will touch the ground, I was then told the tree is in my garden so i'm responsible so i can do what i like with the tree. So as i cannot really afford to have the tree cut down myself i was wondering if i need to contact anyone else as i don't fancy getting a fine once it's cut down.

you must contact the council and ask there guidance
the housing association are nothing to do with tpo

A Tree Preservation Order is not to be trifled with. You need Planning Permission just to reduce the crown and felling will only usually be granted if it is diseased. Quite hefty fines imposed on those who fell without permission. They will also do checks if it dies to make sure it has not been poisoned so forget that tack.

Watching Sarah Beeny last night there was a house that was falling over due to tree's and they said that you can be fined up to £20,000 for cutting tree's with TPO's.

Have many tpo trees and asked the local council if can trim, they have a form which appears only a tree expert could fill out but I did and with a couple of photo prints; the council tree expert called and he said if I had asked to remove one he would have said okay as there was an overlap of cover, however, he gave permission for trimming branches ground up to gutter level of house, crown lifting, apparently that is a rule of thumb. :thumbright:
Armed with his letter of okay quoting all sort of B.Std for safety like don't cut the branch you are sitting on :withstupid: , I got my local gardener/tree surgeon to do the cutting, the one recommended was double the price.

Just looking again at the original post and I missed the point that Corsa is a tenant. Now the Housing Association cannot just pass this off as the tenants responsibility as I would see that they have liability as owner due to the fact it has a TPO and the tenant has little choice what they can do. I would write to the HA explaining the situation and suggesting that they are responsible and hopefully the letter will reach someone with more savvy that the office **** you spoke to.

I agree, large fines if some one has made a clerical error.

I would have asked for the name of the council person and made a file note and then cut it down.

If the council make a mistake then they can take the blame. In any case as they impose the fines then they would choose not to do so in that case.

My surreyheath.gov.uk have a website and you can type in your postcode to get location to see yourself, took a bit of research on web pages, have to accept this disclaimer page 1st.Might be same for your area council web! :scratch:
