Yesterday I discovered a wasps nest in my dry stone wall that runs along the road. Obviously it has been there for a while and now is when they start getting hostile.

Wasps arent my favourite friend (whenever I see one I scream like a Nancy and run off) so I don't want to tackle it. I live out in the country and the only people that walk past that section of wall are the occasional rambler.

My question is, do I have a legal responsibility to get rid of the wasps nest just in case they sting a passer by or am I OK to leave it? They didnt nest there last year so I presume they change nesting sites ever year.

NW, If you ar not sure, just check one out against these.

Wait until you see no further activity then it can be removed before next spring as wasps do not re-use a nest from a previous colony or an older nest from a previous year.
They may build a new one alongside the old nest from last year if the area is OK for them and they like it.

where did I mention bees? :dunno:

If someone does get stung by them - can I see myself dusting off my suit for a trip to court? I have a funny feeling I know where their old nest was last year (about 20 yards away) but I found that early and thought I had smashed it up. I have another wasps next but that is well out of the way so it won't bother anyone. Just wondering about the one on the road

As I said above, Last years nest will not be used again so destroying it does not necessarily mean that they will return to the area to build a new one unless they like the area.

Don't see why, because you are not keeping them, they are not yours, like a bee hive for honey.
You may get into trouble if you tried to get rid of the nest whilst it is populated because they get a bit upset and will sting anyone in the area. So not preventing access the the surrounding area whilst you tried to destroy it could lead you into trouble

Good point Dave. I suppose that if I was liable in some way I would have had a letter off someone by now. I'll leave the wasps to it then - I hardly go past the bit where they are

AFAIK you can't get into trouble for he actions of a wild animal (or insect for that matter) as they are incapable of being 'controlled'. Maybe you're thinking along the lines of dog owners being prosecuted? Similarly a cat owner can't be prosecuted either. The law distinguishes betweeen dogs/cats as being controllable/none-controllable due to their instinctual behaviour. I suggest the same applies to insects.

Wasps..most pointless insect going...and they love freshly mixed mortar at this time of year..(As I have found over the last week or so...) :angryfire:
